Refund and Returns Policy

Dearthwood Software sells digital products and software services. Please read this policy carefully before purchasing. It forms part of our terms of sale.



Digital Products and the Right to Cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a purchase within 14 days without giving a reason. However, this right does not apply once a digital product has been accessed, downloaded, or a licence key has been issued, provided you were informed of this before purchase and gave your explicit consent.



By completing a purchase on this site, you acknowledge that access to the digital product begins immediately upon payment and you consent to waiving your 14-day cancellation right from that point.



Refunds

We do not offer refunds on digital products once a licence key has been issued or a download has been made available. This is consistent with your rights under UK law where explicit consent to immediate access has been given at the point of purchase.



We will issue a full refund in the following circumstances:

  • The product was not as described in any material way.
  • The product was faulty and we were unable to resolve the fault within a reasonable timeframe.
  • You were charged in error, for example a duplicate transaction.
  • Your licence key was not delivered and we were unable to reissue it.


Refunds will not be issued for the following reasons:

  • Change of mind after a licence key has been issued.
  • Incompatibility with your environment where system requirements were clearly stated before purchase.
  • Failure to read the product description or documentation before purchasing.
  • A newer version or alternative product has since become available.


Faulty or Non-Functioning Products

Under the Consumer Rights Act 2015, digital products must be of satisfactory quality, fit for purpose and as described. If a product you have purchased fails to meet these standards, you are entitled to a repair, replacement or refund.



If you believe a product is faulty, please contact us HERE with a description of the issue. We will investigate and aim to respond within 2 working days. Where a fault is confirmed, we will offer a fix, a replacement or a full refund at our discretion.



Subscriptions and Recurring Billing

Where you have purchased a subscription-based product or service, you may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not offer partial refunds for unused time within a billing period unless required to do so by law.

Bespoke and Custom Development Work

Work commissioned on a bespoke basis, including custom plugin development and website builds, is governed by the individual agreement or statement of work agreed in writing before the project begins. Refund entitlements for such work will be set out in that agreement.



As a general position, work already completed and delivered cannot be refunded. Where a project is cancelled mid-way, you will be invoiced for work completed to that point at the agreed rate.



How to Request a Refund

To request a refund, contact us HERE with your order number, the product concerned and the reason for your request. We will review your request and respond within 3 working days.



Where a refund is approved, it will be processed to your original payment method within 5 to 10 working days depending on your bank or card provider.



Your Statutory Rights

Nothing in this policy affects your statutory rights under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
